If you are the adventurous type who wants to buy a piece of wilderness or maybe even looking to speculate with some property development in an urban area you should know the basics of how to buy land, for it's a whole different set of rules from buying a house. There are many things that you need to take into consideration, for example rights of access, availability of utilities such as water and power, easements and land use restrictions. Remember, that when you buy a house, all of these matters have, you assume and hope, already been taken care of.

Step 1: Plan Ahead

You need to be sure you know what you want and that your future dream property wont suddenly end up next to a freeway or high security prison. Most land financing actually comes from the seller themselves. A typical deal might require a 20-percent down payment, with the seller holding a note for the balance. Obviously, depending on the seller, interest rates and payment terms can vary wildly - check the deal before yo commit to it. If your land isn't expensive you may be able to take out a loan against your existing property, or simply approach a local bank who know the area for funding. In any case its vital to ensure that the correct financing is in place not only to buy your land but to develop it to your needs.

A Summary Of The Ways To Profit From A Land Investment

It will come as no surprise to those investing in land that achieving planning permission on a UK land site is where lies the most lucrative investment land returns, but there are other ways to make money from a land investment, writes Alex Way.

Where once English land ownership was the sole preserve of the Royal Family, the Lords of the Realm and sundry blue-blooded families, at the start of the 21st Century Britons lacking a traceable blood-line are increasingly buying land for either investment or commercial purposes. UK land ownership, whilst still concentrated in a small clique (the upper classes, property developers, farmers etc), is now in the national consciousness and is something to which many people aspire. This is unsurprising: ownership levels of property market assets in the UK have always been relatively high (vis-a-vis other northern European countries), and UK land values have soared in the last twenty years. Buying land in the UK is thus an eminently sensible activity.

As a very broad guide, UK land which is reclassified for residential development within the UK land planning framework rises tenfold in value (ie land with planning permission is worth ten times more than a similar piece of land without planning permission). As such few other assets have the same capital growth potential as investment land. That is not to say that the average land investment returns 1000% to investors since to achieve growth on that scale from buying land would require that you undertake the project from start to finish yourself. And many, if not most, people investing in land with a view to taking it through the land planning framework will need to employ somewhere down the line the services of UK land specialists, whose expertise does not necessarily come cheaply.

However it is entirely possible to achieve investment land returns of the order of 350-600% because land developers are opening-up their projects to private investors. The latter in effect provide partial land development funding to these firms in return for which those investors receive a pro rata proportion of the new value of the development land with planning permission. For the purposes of this article we will set to one side this fairly recent phenomenon (recent in the UK, at least - private land development finance is a well-established practice in the US), in order to consider other ways of profiting from investment land.

With a long-term outlook it is possible to make substantial land investment profits from buying land in the path of growth. Land planning expertise need not be 'mixed' with such investment land in order for its value to increase: the returns would be a function of the 'organic rise' in the investment land's value. However this is an extremely speculative form of investing in land, does not usually provide a yield, and as mentioned above is very much long-term in
nature.

You may want to buy land in order to run a commercial enterprise: a caravan site for example, or for those with a more belligerent nature, to operate a paint-balling business. Some UK land owners buy land to lease it to firms requiring storage space: new fleets of cars for example. Still others have been buying land in order to exploit loopholes in the Common Agricultural Policy which give rise to EU subsidies for using UK land for farming/agricultural purposes.

And finally, and perhaps least ethical of all (but entirely legal), is the practice of buying land which provides essential access to a new development: the owner of such access land can effectively hold the owner of the development land site 'to ransom' by demanding an exorbitant price to acquire the access land, which may only be a few square feet in size. Any competent property developer would however avoid such a scenario by ensuring they have full legal access to their development land site, but there remain some people who fall foul of this faintly dubious form of land investment.

In the old days people generally only bought land and improved Real Estate in the areas in which they lived or traveled often. By purchasing land online you can gain land at wholesale prices thus gaining instant
equity. Additionally, you can have enough room to sell that land at a discount to
another party and still make money. Cash is king, so the more you have, the better
deals you will get. However, even if you have little cash, you can still get super deals
on land with owner financing.

What to look out for.

As with anything in life, there are some risks associated with buying land online.
However, you can reduce or practically eliminate your risk by doing some common
things. First, make sure the seller is going to issue you a WARRANTY DEED on the
land you are going to by. Do not accept a quick claim deed. Ask your seller if the
title has any liens, judgments, or back taxes. Sometimes the answer is yes. This is
not a bad thing though. Simply figure in the amount owed into the purchase price.
Many times a seller will lower the price of the land to move it before more penalties
are assessed.

Many times sellers won?t have pictures of the actual lot for sale, but the general
area. This normally happens with parcels that are cheaper because the seller might
not live in the area and it is not financially viable to travel there to take a picture.
When this is the case, make sure the place exists first and then do some research on
the area. For example, go to a search engine and type in the county, city,
subdivision, or other data that is identifiable like a lake.

Finally, ask the seller what the taxes and HOA fees, if applicable, are.

Types of Deeds Used in Land Purchase

There are many different types of Deeds which can be used to convey real estate. Many of our buyers, especially buyers who have previously owned real estate, want to know what type of deed we use to grant ownership of property to you, the buyer. I'll explain this in detail, but I'd also like to discuss several other types of Deeds, and the advantages and disadvantages of each.

Warranty Deed

The Warranty Deed is the most common type of Deed used in Arizona because it offers the best protection to the buyer. In Oregon, Warranty Deeds are also commonly used. In California, Warranty Deeds are also used, but they are uncommon. The closest equivalent to a Warranty Deed in California is a Grant Deed, but in this discussion I will use Warranty Deed to also mean Grant Deed.

The Warranty Deed contains three warranties. These warranties are promises that the seller makes to the buyer regarding the condition of the title to the property.

The first promise is the Covenant of Seisin. By the Covenant of Seisin the seller warrants that he or she actually owns the property and has the right to sell it.

The second promise is the Covenant Against Encumbrances. Like the name implies, this is the seller's promise that the property is free and clear of any encumbrances (liens, loans, mortgages, taxes, etc...).

The third promise is the Covenant of Quiet Enjoyment. This obligates the seller to defend the title against any claims as of the moment the deed is delivered to the buyer. In other words, if a third party appears two years after the warranty deed has been delivered to the buyer, and claims to have an interest in the property, the seller is required to defend the title which was given to the buyer.

We always use Warranty Deeds to convey land to our buyers when the land is paid in full. Remember, when you purchase property, always insist on obtaining a Warranty Deed when the property is paid off!

Bargain and Sale Deed

A Bargain and Sale Deed is a much weaker instrument than a Warranty Deed. When a seller uses a Bargain and Sale Deed, the buyer does not get any of the three covenants that a Warranty Deed conveys. In addition, the seller is under no obligation to defend the title.

Quitclaim Deed

The third and final type of commonly used Deeds is a Quitclaim Deed. This is, without question, the weakest instrument one could use to convey property. Where a Warranty Deed guarantees that the seller owns the property, and is selling it to a buyer, and will defend the title and give the three promises, the Quitclaim Deed contains none of these guarantees.

Basically, a Quitclaim Deed states -- IF the seller has an interest in the property, they are giving it to the buyer. Notice the word IF. In other words, "if it turns out that I have an ownership in this property, then I'm giving whatever interest I may have to you, Ms. Buyer." It would be perfectly legal for me to give you a Quitclaim Deed to the White House -- if I have an interest in it, I'm giving it to you. There are no guarantees with a Quitclaim Deed, and the seller is making no promises. Obviously, we never use Quitclaim Deeds to convey any of our land parcels. It just doesn't give the buyer any security.
